Credit Card Payments

Payments will be processed using the Paystation system for online transactions. Any credit card details that are retained for recurring payments will be stored in the secure Paystation system. No credit card details are stored by us.

Payments must be received prior to orders being delivered.

Automatic Payments

It is essential that a clear reference name or number is provided with all Automatic payments. If an automatic payment is made and we cannot link this to a customer or order, we take no responsibility for the delay in the delivery. Automatic payments must be received prior to the products being delivered.

Cash Payments

Paying us in cash can only be arranged by calling our office to organise this. Ph: 09 4422915

If you have arranged to pay the delivery driver in cash, please have the correct money available to pay as our drivers will not ordinarily carry change. If you are not there to accept the delivery and have not left payment, the order will not be delivered.

Refunds

We hope this never happens, but if for some reason you are unhappy with any of our products, please notify us within 24 hours of delivery so that we can resolve the problem. Where possible we will replace the item, but if we can’t sort it out, we will credit or refund you for the unsatisfactory item.

Deliveries

We will always endeavour to deliver on the day and at the time requested. However we do not guarantee this. . If for some reason we cannot deliver on the day requested, we will advise you by email or phone and arrange an alternative.

Products Purchased

We will always do our best, but we cannot guarantee the supply of all of the produce that we note on our weekly availability list. Due to a number of factors, certain items may be unavailable. We will replace the missing item with an equivalent alternative.

Cancellations

Because fresh produce is so perishable, we cannot accept cancellations on the day of delivery. However if you let us know by 5pm the day before we will cancel the delivery and arrange the refund.

Refusal

We reserve the right to refuse orders for any reason.

Outstanding Debts

If we are unable to recover money owed by you via our internal recovery process. We will transfer this debt to Credit Consultants, a professional debt recovery agency for collection by them. Any fees charged by Credit Consultants will be added to your debt and you will required to pay these in addition to your original debt.

Disclaimers

We have endeavoured to ensure that the information on this website is free from error. We reserve the right to make changes to the information provided on the website at any time and without notice.

Limitation of Liability

Except where the law prohibits it, Fruit Guys NZ Ltd will not be liable for any indirect, consequential, exemplary, incidental or punative damages.

Fruit Guys has taken many steps to ensure that your information is well protected. However it is important that you remember to never share your Login with any other person. Fruit Guys endeavours to keep your personal information collected on the Website secure and confidential, Fruit Guys shall not be responsible for any breach of security caused by third parties, nor represents that the Website is completely secure.

New Zealand law governs the use of this website and these terms and conditions.

The Website contains applications which collect personal information about you. Fruit Guys will only use this information to the extent authorised by you, and will only disclose it in the manner set out below.

In using the Website, you authorise Fruit Guys to collect, retain and use their personal information for the purposes of:

(a) processing your registration application;

(b) undertaking any dealings or transactions with you;

(d) sending you any advertising or promotional material; and
